One AI spam flag does not automatically lead to a 15-day call bar. Under TRAI’s 2026 rules, five or more phone numbers linked to the same sender must be flagged as high-probability spam within 10 days before the AI-based checks begin. The operator first re-verifies the sender’s KYC. A 15-day bar may follow a second qualifying event if physical checks find a mismatch or misuse.

Customer complaints can also lead to action through a separate process. In some cases, operators can begin checking a sender after three complaints if AI has also flagged a linked number. Five complaints can also trigger action without an AI flag.

TRAI’s Third Amendment to the Telecom Commercial Communications Customer Preference Regulations was notified on 18 September 2026. The rules will come into force in stages. Here is what businesses that call customers need to know.

How can a business face action without a customer complaint?

TRAI’s amendment allows telecom operators to use AI and machine learning to identify phone numbers that show a high chance of sending Unsolicited Commercial Communication (UCC). UCC is the term used for commercial calls or messages that do not follow the applicable rules.

A Calling Line Identification (CLI) is the phone number or caller ID linked to a call. Operators can use KYC records to find other numbers and telecom resources linked to the same sender.

The important point is this: one flagged number is not enough to trigger the AI-based process. Five or more numbers linked to the same sender must be flagged within 10 days.

What happens under the AI-based process?

Stage

What happens

Five or more linked numbers are flagged within 10 days

Operators begin checks using the sender’s KYC details.

First time the threshold is reached

The operator re-verifies the sender’s KYC. Even if the details are correct, this counts as the first instance.

Second time the threshold is reached

The operator carries out physical KYC checks and checks whether the telecom resources are being misused.

A mismatch or misuse is found

Outgoing calls from the sender’s telecom resources may be barred for 15 days. This can include SIMs, PRI lines and SIP trunks, even if some were not used for the flagged calls.

Further misuse is found

The sender may face stronger action, including disconnection and blacklisting.

If the sender’s KYC details match during the second check and no misuse is found, the 15-day bar does not automatically apply. However, the event still counts as the second instance. A later instance can lead to another check.

Can customer complaints also lead to a 15-day call bar?

Yes. The complaint process is separate from the AI-based process described above.

For an unregistered telemarketer, operators can start action if either of these conditions is met within 10 days:

Three or more different people complain, and a number linked to the sender is also flagged by AI.

Five or more different people complain, even if there is no AI flag.

The operator may suspend the telecom resources used for the suspected UCC while it investigates. The sender gets an opportunity to respond. If the operator confirms a violation, the first confirmed violation can lead to a 15-day bar across the sender’s telecom resources. Further violations can lead to a one-year disconnection and blacklisting.

The rules have separate procedures for registered senders. The right process can depend on the type of sender and call, so check with your telecom provider.

Can all of a company’s numbers be affected?

They can be. Operators use KYC details to identify telecom resources linked to the sender. Depending on the route and the investigation, action may affect several SIMs, PRI lines or SIP trunks.

Moving calls to another SIM may not solve the issue if that number is also linked to the same sender through KYC. It can also make it harder to track who made the calls and why.

Do calls made through software need to be declared?

TRAI defines an Application-to-Person (A2P) call as a voice call started by an application, software system or automated platform without a person directly dialling the number. This includes auto dialling, robocalls, and prerecorded or artificial voice calls.

Businesses that use A2P calls must tell their originating telecom provider in advance and share the numbers they will use. Calls made without the required declaration are treated as UCC.

Declaring A2P use does not give a business permission to make promotional calls. Businesses still need to follow the rules that apply to the call’s purpose and the customer’s preferences.

Read our guide to A2P calls and TRAI’s 2026 rules.

Which businesses should review their calling process?

Any business that makes commercial calls should review its process. This is especially useful for teams that use diallers, run calling campaigns or contact people from older lead lists.

A high number of calls alone does not prove that a business is sending spam. The amendment sets out specific thresholds and checks. It does not give businesses a simple daily call limit that guarantees their numbers will be safe.

Here are some useful checks:

List all the numbers your business uses. Check which company or person each number is registered to.

Find out how your calls are started. Separate calls dialled directly by agents from calls started by software.

Declare A2P calling if it applies. Ask your telecom provider what details it needs and confirm that your calling numbers are recorded correctly.

Check customer preferences before promotional calls. Follow the rules for consent, Do Not Disturb preferences and opt-outs.

Keep proof of customer enquiries and consent. An old contact list alone does not show that a customer agreed to be contacted.

Use the right number series for each type of call. Ask your provider which series applies to your calls. You can also read our guide to 140 numbers.

Review complaints and call records. Check whether a particular campaign, lead source or call purpose is causing problems.

If a customer has sent a written or online enquiry, the amendment allows commercial communication about that enquiry for seven days. Keep a record that you can verify later.

For more details, read our guide on why business numbers get marked as spam.

Do 140, 1600 and 1601 numbers keep calls safe?

TRAI’s amendment says numbers in the 140xx, 1600xx and 1601xx series, along with other designated series, should not be flagged as suspected spam through this process. Call management applications also cannot blanket-tag, filter or block calls from these series.

Customers can still block individual calls on their phones. Using a designated series also does not make every call acceptable. Ask your telecom provider which series your business can use and what type of calls it covers.

What Should You Do If Your Number Is Flagged?

If your telecom provider contacts you about a suspected UCC flag or KYC check, take these steps.

1. Ask Which Number Was Flagged

Contact your provider and confirm which number was flagged. Ask what checks or documents you need to submit.

2. Keep Your KYC and Number Records Ready

Keep your company KYC details, number allocation records, call logs and campaign information in one place. These records can help you respond quickly.

3. Show Why You Contacted Customers

Keep proof of customer enquiries, consent and preference checks. This can help explain why your team called a particular customer.

4. Respond Through Your Provider’s Process

Use the process given by your telecom provider to explain your case or challenge the AI flag. The amendment requires providers to give senders a way to respond to these flags.

5. Fix Any Gaps Before Restarting Calls

Review the campaign, check what may have caused the flag and correct any issues before your team starts calling again.

How Can CallerDesk Help Your Team Manage Business Calls?

CallerDesk offers features such as call recording and call reports to help your team review conversations, track follow-ups and spot calling patterns that may need attention.

These tools can support better calling practices, but they cannot guarantee that a number will not be flagged. Your business must still follow applicable telecom requirements, respect customer preferences and make any required A2P declarations.

Book a CallerDesk demo to explore the features and see how they may fit your team’s calling needs.

Conclusion

TRAI’s 2026 rules give telecom operators two ways to act against suspected spam: AI-based checks and customer complaints. A business can face checks even if no customer complains, but one AI flag does not automatically stop its calls for 15 days. The AI process looks at linked numbers, KYC details and possible misuse.

Keep your number records, A2P declarations and customer enquiry details in order. If your team receives a flag or KYC notice, contact your telecom provider and respond with clear records.
